1. Height Breach: The finished height of the structure at the rear of 2 Loftus Close, including required ‘Warm Roof’ insulation and capping, appears to exceed the 3-metre height limit for a flat-roofed extension set out in Class 1} Column 2, Condition 1(b) of the Planning and Development Regulations, 2001. 2. Loss of Residential Amenity: The scale and proximity of the 17ft masonry wall on the boundary results in a significant loss of outlook and an overbearing impact on the habitable rooms of my property at 1 Loftus Close. The wall creates a 'tunnel effect,' reducing natural light and visual amenity. The distance from my rear living room window to the wall is less than 1 meter, exacerbating the impact, We have lived here for 14 years. Loss of paho use 3. The developer has no legal access to my property at 1 Loftus Close, so the structure cannot be completed or maintained entirely within the curtilage of the developer’s site, as required for exempted development. 5. Surface Water & Encroachment Issues/Future Risks: • The structure is built flush to the legal boundary line. • Any guttering or fascia fitted to the external face will permanently encroach into my property at 1 Loftus Close. • Without guttering, rainwater will be discharged onto my property, causing nuisance and potential structural damage. • Use of an internal box-gutter/parapet system would require additional masonry, further increasing the overall height beyond 3 meters. • The lack of legal access for maintenance means future structural or water-related damage to my property cannot be prevented, posing long-term risks.
